Article 2 – Scope of Application

These terms and conditions apply to all offers, orders, and agreements concluded through the Charles&Co. online store.

By placing an order in the online store, the customer accepts these terms and conditions.

Article 3 – Offers and Prices

All prices are stated in US dollars (USD), include sales tax where applicable, and exclude shipping costs.

Charles&Co. reserves the right to change prices and products without prior notice.

Article 4 – Orders and Payment

Payment must be made using the payment methods available on the website.

An order will only be processed once full payment has been received.

Article 5 – Delivery

Orders are delivered within 6 to 10 business days after receipt of payment, unless stated otherwise.

Delivery takes place to the address provided by the customer.

Charles&Co. is not responsible for delays caused by the carrier or for circumstances beyond its control.

Article 6 – Returns and Right of Withdrawal

The customer has the right to return the order within 30 days of receipt without giving any reason.

After receiving the return, the full purchase amount, including the original shipping costs, will be refunded. Return shipping costs are borne by the customer.

Products must be unused, undamaged, and, if possible, returned in the original packaging.

Article 7 – Warranty

Charles&Co. guarantees the quality of the delivered products.

If a product proves to be defective or damaged upon delivery, the customer must report this within 7 days of receipt.

Article 8 – Liability

Charles&Co. is not liable for damages resulting from improper or unintended use of the products.

The liability of Charles&Co. is limited to the purchase amount of the product concerned.

Article 9 – Privacy

Charles&Co. processes personal data exclusively in accordance with applicable data protection laws, including the GDPR and relevant U.S. data protection regulations.

Article 10 – Governing Law and Jurisdiction

These terms and conditions, and any disputes arising from them, shall be governed exclusively by the laws of the State of Delaware, USA.

All disputes shall be brought before the competent courts of the State of Delaware, unless otherwise required by mandatory consumer protection laws.

Article 11 – Arbitration Agreement

By using this website and purchasing products from Charles&Co., the customer agrees that any dispute, claim, or controversy arising out of or relating to these terms and conditions, or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved exclusively by binding arbitration.

• The arbitration shall be conducted in Wilmington, Delaware, USA, in English.

• The arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

• Each party shall bear its own legal fees and costs, unless the arbitrator decides otherwise.

• The arbitrator’s decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

The customer waives the right to bring any claims in court or to participate in a class action or representative proceeding.
